2. Agreement
2.1 These terms are an agreement between you and Squash Australia. You accept them when you register or renew through MySquashAUS.
2.2 When you register with an Affiliated Entity, you also become a member of the relevant State & Territory Member and of Squash Australia, as set out in the Membership & Registration Policy.
2.3 A State & Territory Member or Affiliated Entity may apply its own additional terms. If those terms conflict with these terms, these terms prevail to the extent of the conflict.
3. Eligibility and applications
3.1 Membership is open to people of all ages in the categories set out in the Membership & Registration Policy.
3.2 There is no automatic right to membership. We, or the relevant State & Territory Member, may accept your application, accept it with conditions, or reject it, in line with the Constitution and the Membership & Registration Policy.
3.3 Your membership is not finalised until your mandatory details are complete, your fees are paid in full, and any outstanding debts or disciplinary matters are resolved.
Part B – Your membership
4. Membership term and renewal
4.1 The membership year runs from 1 July to 30 June. Your membership starts when your registration is confirmed in MySquashAUS and ends on the following 30 June, whatever date you join, subject to the Renewal Period in clauses 4.3 to 4.5.
4.2 New memberships received on or after 1 June are registered for the following membership year.
4.3 To keep your membership, you must renew through MySquashAUS by 31 July each year (the Renewal Period is 1 July to 31 July).
4.4 For the avoidance of doubt, if you were a financial member on 30 June, your membership continues during the Renewal Period as if it had been renewed. During that period:
- you remain a member of Squash Australia, your State & Territory Member and your Affiliated Entity;
- you remain bound by these terms, the Constitution and all Policies, and any complaint or disciplinary matter may be dealt with as if you were a current member;
- you remain covered by the Squash Australia National Insurance Program for sanctioned Activities
4.5 If you have not renewed by the end of the Renewal Period, your membership ends at 11.59 pm on 31 July, along with your benefits and insurance cover.
5. Membership categories and benefits
5.1 Your benefits depend on your membership category (Compete, Local, Social, Support, Digital or MySquashPass), as described in the Membership & Registration Policy and on our Member Benefits page.
5.2 Benefits may change from year to year. We will publish the benefits for each membership year before renewals open, and will give you reasonable notice if we need to change a significant benefit during the year.
5.3 Some benefits, such as SquashLevels and SquashAUSTV, are provided by third parties and are subject to their own terms of use.
5.4 You must hold the right category for the Activities you take part in. You may play in a higher category up to three times in a membership year, after which you must upgrade.
6. Fees and payment
6.1 Membership fees are made up of National, State & Territory, and (where applicable) association and club components. All fees must be paid in full through MySquashAUS.
6.2 National fees for each membership year are set by 1 May, and normally increase each year by the Consumer Price Index or by an amount set by the Squash Australia Board. We will publish fees before renewals open.
6.3 If your fees are unpaid, you are not a financial member and you are not entitled to membership benefits or insurance cover.
7. Cancellation and refunds
7.1 You may cancel your membership at any time by notifying us or your Affiliated Entity in writing.
7.2 Once your cancellation is confirmed, your membership benefits and insurance cover end.
7.3 Refunds of the national fee component are available only as set out in clause 5.3 of the Membership & Registration Policy. State & Territory Members and Affiliated Entities may have their own refund policies for their components.
7.4 Nothing in these terms limits any refund or other remedy you are entitled to under the Australian Consumer Law.
Part C – Conduct and integrity
8. Compliance with rules and policies
8.1 You agree to be bound by, and to comply with, the following, each as amended from time to time and available on our Policies and Integrity pages:
- the Squash Australia Constitution;
- the National Integrity Framework: the Member Protection Policy; Safeguarding Children and Young People Policy; Competition Manipulation and Sport Gambling Policy; Improper Use of Drugs and Medicine Policy; and Complaints, Disputes and Discipline Policy;
- the Australian National Anti-Doping Policy;
- the Squash Australia Code of Conduct, Social Media Policy, Photo & Video Policy and LGBTQ Inclusion Policy;
- the Membership & Registration Policy and Privacy Policy;
- any rules, by-laws and policies of your State & Territory Member and Affiliated Entity; and
- the rules of any Activity you enter.
8.2 It is your responsibility to be familiar with these documents and any updates we tell you about.
8.3 You agree to act in the best interests of squash and not to bring the sport or any Squash Organisation into disrepute.
9. Discipline
9.1 A breach of these terms or of any document in clause 8 may lead to action under the Complaints, Disputes and Discipline Policy or the relevant policy, including warnings, suspension or termination of your membership.
9.2 You must comply with, and help give effect to, any disciplinary decision made under the Constitution or those policies, including decisions made by a State & Territory Member or Sport Integrity Australia.
10. Safeguarding and reporting
10.1 We have zero tolerance for abuse of any kind. You commit to helping keep everyone involved in squash safe, particularly children and young people, from abuse, harassment, bullying, discrimination, grooming and other misconduct.
10.2 If you hold a role that involves working with children, you must hold and maintain a valid Working with Children Check (or equivalent) as required by law in your State or Territory and by our Safeguarding Children and Young People Policy.
10.3 If you see, hear or experience any integrity concern, including child safety issues, abuse, harassment, bullying, match-fixing or doping, you must report it through one of these channels:
- Squash Australia Integrity: integrity@squashaus.com.au
- Squash Australia Online Complaints
- Safe Sport Hotline: 1800 161 361
- Sport Integrity Australia: sportintegrity.gov.au
10.4 If a person(s) are in immediate danger, call 000.
Part D – Safety
11. Risks of participation
11.1 Squash is a fast, physical sport played in an enclosed space. Accidents happen. Taking part in Activities carries risks, including collisions, eye and head injuries, concussion, cardiac events, other personal injury, death and damage to property.
11.2 You acknowledge those risks and accept them as part of your participation, including any risks linked to a health condition you have.
11.3 You must follow the safety rules of each Activity, including any protective eyewear requirements.
12. Medical fitness, concussion and injuries
12.1 You confirm that you are, and will remain, medically and physically fit to take part in the Activities you enter, and that you are not a danger to yourself or others.
12.2 You must not take part if you have a medical condition (physical or mental) that increases the risk of injury to you or others, unless you have medical clearance.
12.3 If you are suspected of having a concussion, you must stop playing immediately. You must not return to play until you have followed the graduated return-to-sport process in the AIS Concussion and Brain Health Position Statement and any Squash Australia concussion guidance.
12.4 If you are unable to consent at the time, you consent to any first aid or medical treatment that a Squash Organisation reasonably believes is necessary. You are responsible for the cost of that treatment, except where it is covered by insurance.
12.5 You must report any injury, accident or damage during an Activity to the organiser as soon as practicable, and before leaving the venue where possible.
13. Insurance
13.1 Financial members are covered by the Squash Australia National Insurance Program while taking part in sanctioned Activities, as described on the insurance page.
13.2 The cover is limited and subject to the policy's terms, conditions, limits, excesses and exclusions. It does not cover every risk.
13.3 You are encouraged to consider your own private health, ambulance and income protection insurance.
13.4 You are not covered if you are not a financial member, or for activities that are not sanctioned.
14. Release and indemnity
14.1 To the extent permitted by law, you release each Squash Organisation, and its directors, officers, employees and volunteers, from all claims arising from or connected with your membership or your participation in any Activity.
14.2 To the extent permitted by law, you indemnify each Squash Organisation against any claim by another person arising from your participation in an Activity or your breach of these terms.
14.3 This clause does not apply to the extent a loss is caused by the negligence or wilful misconduct of a Squash Organisation, and it does not exclude, restrict or modify any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Part E – Your information
15. Privacy
15.1 We collect, use, store and disclose your personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth). We use it to administer your membership, run and promote squash Activities, calculate rankings and ratings, manage integrity and safety matters, and send you information about squash.
15.2 We may share your information with State & Territory Members and Affiliated Entities, our insurers and professional advisers, government sport and integrity bodies (such as the Australian Sports Commission and Sport Integrity Australia), and service providers such as revolutioniseSPORT (MySquashAUS), SquashLevels, SquashAUS.TV, the Australian Sport Learning Centre (ASLC) and Rely (online complaints). Your MySquashAUS account uses single sign-on with SquashLevels and the ASLC, as described in the Privacy Policy.
15.3 Some of these providers store or process information outside Australia, including in the United Kingdom and other countries. We take reasonable steps to ensure they handle it in line with the Australian Privacy Principles.
15.4 Where we collect sensitive information, such as health information needed to keep you safe, you consent to its collection and use for that purpose by accepting these terms.
15.5 Your competition results, rankings and ratings may be published.
15.6 You can opt out of marketing communications at any time through MySquashAUS or the unsubscribe link in any message. You can also ask to access or correct your information, or make a privacy complaint, as set out in the Privacy Policy. Contact: privacy@squashaus.com.au
15.7 If you do not provide the information we request, we may not be able to accept your membership or entry into Activities.
16. Image and media
16.1 Activities may be photographed, filmed, broadcast and livestreamed, including on SquashAUSTV.
16.2 You consent to Squash Organisations using your name, image, voice, likeness and performance (in any medium) to promote and report on squash, and to administer it (for example, to investigate an integrity matter or support a disciplinary hearing), without payment and without further consent, in line with the Photo & Video Policy.
16.3 You may withdraw or limit your consent for promotional use at any time by contacting us. Withdrawal does not apply to material already published, to live broadcasts of public Activities, or to administrative use under clause 16.2.
16.4 Images of people under 18 are handled in line with the Safeguarding Children and Young People Policy and the specific provisions for the capture of images of people under 18 outlined in the Photo & Video Policy.
17. Accurate information
17.1 You confirm that the information you give us is accurate, complete and up to date.
17.2 You must update your details in MySquashAUS during the membership year if anything changes, and must not create duplicate profiles.
17.3 We and State & Territory Members may audit membership records for accuracy.
Part F – Other terms
18. Members under 18
18.1 A person under 18 must be registered by their parent or legal guardian.
18.2 If you register a person under 18, you confirm that you are their parent or legal guardian, and that you:
- consent to them becoming a member and taking part in Activities;
- accept these terms on their behalf and on your own behalf, including clauses 11 to 16;
- will help them understand and comply with the Code of Conduct and the policies in clause 8; and
- accept responsibility for their behaviour, and agree to be bound by the Policies yourself when attending Activities as a parent, guardian or spectator.
19. Suspension and termination
19.1 We, or the relevant State & Territory Member, may suspend or terminate your membership:
- if you do not renew or pay your fees;
- after a finding under the Complaints, Disputes and Discipline Policy or another policy in clause 8;
- if you seriously or repeatedly breach these terms; or
- if your behaviour puts the safety or wellbeing of other participants at risk,
in each case in line with the Constitution and any procedure the relevant policy requires.
19.2 Where the risk to others requires it, we may provisionally suspend you while a matter is investigated, as allowed by the relevant policy.
19.3 If your membership is terminated for a breach, you are not entitled to a refund, except as required by law.
20. Changes to these terms
20.1 We may update these terms, for example to reflect changes to the law, our Policies or how we run the sport.
20.2 We will publish the current version on our website with its effective date. We will give members at least 30 days' notice of any change that materially reduces your rights or benefits. Changes do not apply retrospectively.
21. General
21.1 These terms are governed by the laws of Queensland, Australia.
21.2 If any part of these terms is invalid or unenforceable, it is read down or severed, and the rest continues to apply.
21.3 If we do not enforce a right straight away, we do not give it up.
21.4 These terms, the Constitution and the Policies make up the whole agreement between you and Squash Australia about your membership.
